Overview

Welcome to the GoemonYae Trading System ("GYTS"). By accessing our website, Discord community, TradingView indicators, YaeBot, or any other products or services we offer (collectively, the "Services"), you agree to comply with and be bound by the following terms. Please read them carefully.

Like our multi-layered trading algorithms, these terms are structured to provide clarity, precision, and protection for all participants in our ecosystem.

Definitions

For clarity and precision in our agreement:

• "GYTS", "we", "us", or "our" refers to GoemonYae Trading System, a brand of [LEGAL ENTITY NAME], a company registered in The Netherlands.
• "Services" refers collectively to our website, YaeBot (including its financial simulations and data analysis tools), TradingView indicators (Community and Professional Editions), Discord community, and any other products or services we offer.
• "User", "you", or "your" refers to any individual or entity accessing or using our Services.
• "User Content" refers to any data, information, or material you provide to the Services, including simulation parameters.
• "Algo Apprentice Path", "Goemon Warrior Path", and "GoemonYae Master Path" refer to our different subscription tiers, ranging from free access to premium services with varying levels of access to our Services.

Eligibility and Account Responsibilities

As precise inputs lead to accurate trading outcomes, your account information must be maintained with equal care:

• You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to subscribe to our paid Services.
• For all Services, you must meet the minimum age requirement of the Discord platform (typically 13 years of age, but may be older in your country). Users under 18 may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
• You are responsible for maintaining the confidentiality of your Discord account and any passwords associated with your access to our Services.
• You agree to notify us immediately of any unauthorised use of your account or any other breach of security.
• You are responsible for all activities that occur under your account.

Your account serves as your identity within our ecosystem—protect it with the same vigilance you would apply to your trading capital.

Subscription Terms

For users of our premium services:

• Subscriptions are processed through our third-party payment processor, such as Whop.
• Subscription fees are charged in advance on a monthly or annual basis as selected during signup.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellations take effect at the end of the current billing period.
• Price changes will be communicated at least 30 days in advance of implementation.
• Refunds are processed in accordance with our Refund Policy section below.

Like a trading strategy that must adapt to changing markets, we reserve the right to modify our subscription offerings and pricing with appropriate notice.

Refund Policy

Our approach to refunds mirrors our trading philosophy of clarity and defined parameters:

• Due to the immediate access granted to our proprietary digital content and intellectual property upon subscription, we generally do not offer refunds. This policy is based on the nature of our digital services.
• For Consumers in the European Union: You have a statutory right to withdraw from your subscription within 14 days of purchase. However, when you subscribe to our Services, you provide your express consent to begin the supply of digital content immediately and acknowledge that you thereby lose your right of withdrawal.
• Notwithstanding the above, we may consider refunds for annual subscriptions on a case-by-case basis within the first 14 days if the Services are demonstrably non-functional or inaccessible due to a fault on our part.
• All refund requests must be submitted through our official support channels, such as our Discord server or by email to support@goemonyae.com.

Intellectual Property

Our trading algorithms and methodologies represent years of mathematical refinement and development:

• All content, code, algorithms, indicators, methodologies, and related materials provided through our Services are the exclusive property of GYTS or its licensors.
• You are granted a limited, non-exclusive, non-transferable license to use our Services for personal or internal business purposes only.
• You retain full ownership of your User Content. You also own the specific, final outputs (e.g., charts, reports) generated from your data. However, the underlying algorithms, methodologies, and code used to generate these outputs remain the exclusive property of GYTS.
• You may not reverse engineer, decompile, or disassemble any aspect of our Services.
• You may not distribute, lease, license, sell, or otherwise commercialise our Services or content without explicit written permission.

Like Goemon's prized tools, our intellectual property represents the essence of our craft—we protect it accordingly while sharing its benefits with our community.

User Content

You provide inputs to our system, and you are responsible for that content:

• License Grant: By submitting User Content, you grant GYTS a worldwide, non-exclusive, royalty-free license to use, process, store, and display that content solely for the purpose of operating, providing, and improving the Services for you. This includes using anonymized data for our internal analytics to enhance our models.
• Your Responsibility: You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any laws or third-party rights. You are responsible for ensuring your User Content does not contain sensitive personal information you do not wish to share.
• Data Handling: Generated assets such as charts and reports are stored temporarily for processing and are automatically deleted from our systems within 24 hours, in accordance with our data minimization principles. Our Privacy Policy provides more detail on our data handling practices.
• We reserve the right to remove any content at our discretion without notice.

Third-Party Dependencies

Our services are built upon a foundation of trusted platforms, and your use of GYTS acknowledges these relationships:

• Discord: Our Services, particularly YaeBot, are delivered through the Discord platform. Your use of the Services is therefore also subject to Discord's Terms of Service and Privacy Policy. GYTS is not responsible for the availability, functionality, or policies of Discord.
• Payment Processors: We use third-party payment processors like Whop to handle subscriptions. Your payment information is provided directly to them and is subject to their terms and privacy policy. We do not store your payment card details.
• Content Delivery Networks (CDNs): Some interactive charts generated by YaeBot may load resources from third-party CDNs (e.g., Plotly). Your browser's interaction with these CDNs is subject to their respective privacy policies.

Service Availability and Performance

In the spirit of transparency that guides our mathematical approach to markets:

• YaeBot operates on self-hosted, dedicated hardware, not on a major cloud provider. This architecture means the service is dependent on a single server without automated failover or redundancy.
• We do not provide a Service Level Agreement (SLA) or uptime guarantee for any of our Services.
• Occasional maintenance, network issues, or other technical challenges may temporarily impact Service availability. We will communicate any significant disruptions through our Discord community.
• Our commitment is to apply the same mathematical precision to service restoration as we do to our trading strategies—prioritising accuracy over haste.

Privacy and Data

Protecting your data is fundamental. Our Privacy Policy is incorporated by reference into these Terms and explains in detail what data we collect and how we use and protect it. By using our Services, you agree to the collection and use of information in accordance with our Privacy Policy.

Disclaimers and Risk Disclosure

With the mathematical honesty that guides our trading approach:

• No Warranty: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or completely secure.
• Educational Purposes Only: All content, tools, and simulations are provided for educational and informational purposes only. They do not constitute financial advice, investment advice, trading advice, or any other form of professional advice.
• No Guarantee of Results: We make no warranties regarding trading results. Past performance, whether actual or indicated by historical tests of strategies, is no guarantee of future performance. Market conditions are inherently unpredictable.
• High Risk Activity: Trading financial instruments involves significant risk and may not be suitable for all investors. You should carefully consider your investment objectives, financial situation, and risk tolerance before trading. We strongly recommend consulting with a qualified financial advisor.

Even the most rigorous mathematical systems must account for risk—our approach embraces this reality rather than dismissing it. Like Yaezakura's petals, resilience comes through acknowledging and adapting to changing conditions.

Limitation of Liability

With defined parameters that form the foundation of our relationship:

• To the maximum extent permitted by law, GYTS shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses.
• GYTS shall not be liable for any issues, damages, or losses arising from the failure, interruption, or data breach of any third-party service on which we depend, including but not limited to Discord.
• Our total liability is limited to the amount you paid for our Services in the 12 months preceding the claim, or €100, whichever is greater.

Termination

Either party may conclude our agreement under these conditions:

• You may terminate your use of our Services by cancelling your subscription and discontinuing use of our products.
• Your access to the Services is contingent on your membership in our designated Discord server. Leaving the server will result in immediate loss of access. This does not automatically cancel any active paid subscriptions, which must be managed through the payment processor.
• We reserve the right to terminate or suspend your access to our Services at our discretion, with or without notice, for conduct that we believe violates these Terms.
• All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

Governing Law & Jurisdiction

As mathematical formulas require consistent interpretation:

• These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.
• Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, The Netherlands.
• For consumers residing within the European Union, this choice of jurisdiction does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence.
• The European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in an online dispute resolution procedure.

General Provisions

Like markets evolve, so too may our terms:

• Changes to Terms: We reserve the right to modify these Terms at any time. We will provide notice of significant changes through our website or Discord community. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.
• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
